How A Whistleblower Gets Paid

The Federal False Claims Act is designed to combat fraud against the United States government by incentivizing private individuals who have evidence of such fraud to blow the whistle and report the fraud. The Act provides for recovery and significant penalties against companies that have presented false claims to the government, often involving Medicare, Medicaid, defense contracting, construction contracting, or importing. As a reward for their contribution to the case, whistleblowers are entitled to a share of the recovery. Many states, including Georgia, have a similar false claims law.

Companies defrauding the government face penalties of between $5,500 and $11,000 for each violation and three times the amount of damages which the government sustained because of the fraud. Additionally, the company has to pay for the costs and reasonable expenses incurred in bringing the suit.

In a case where the government decides to " intervene," or step in and take primary responsibility for the suit, the individual who blew the whistle is still entitled to 15-25 percent of the proceeds, depending upon the person's contribution to the case. Where the government does not intervene, the whistleblower is entitled to 25-30 percent of the proceeds.
