McDaniel v. Mitsubishi and Silney, Court of Common Pleas, State of South Carolina (4/15/99)

The case involved the propensity of the Mitsubishi Montero SUV to rollover, the propensity of the Takata seat belt to unlatch, and the propensity of Mitsubishi door latches to come unlatched in collisions and rollovers. Plaintiff proved that Mitsubishi had concealed evidence of door latch and seat belt failures from the trial court in violation of numerous trial court orders. A motion for default judgment as a result of this discovery abuse was pending at the time of the settlement. At defendants' request, the amount of the settlement is confidential.
