(reversing the burden of proof and finding that all of the defendant's insureds' loans terminated early and were due the average refund amount, a sanction the defendant valued in excess of $400 million.)

(finding that 327,401 certificates for which the defendant failed to timely produce a loan termination date in response to the Court's Order terminated prior to their scheduled maturities.) 2003-10-28 Ayers v. Hughes Spalding Children's Hospital , State Court of Fulton County, Ga., Case No. 02-VS-032624 (Issue preclusion: the hospital lost the patient's medical records. The Court's Sanctions Order established that the hospital deviated from the standard of care and that such breaches were a proximate cause of the patient's death. The hospital was further prohibited from introducing at trial any evidence that its agents did not breach the standard of care or that such breaches were not a proximate cause of the child's death.).
